Terms of Service

OVERVIEW

This website is operated by Halvane Living Ltd, trading as Halvane Living, a company registered in England and Wales under company number 17382954.

Our registered office is Unit A, 82 James Carter Road, Mildenhall, IP28 7DE, United Kingdom.

The terms “we”, “us” and “our” refer to Halvane Living Ltd.

These Terms explain how you may use our website and the terms on which we sell products to you. They apply to purchases made by consumers for personal and household use. If you wish to purchase for business use or resale, please contact us before ordering.

Our store is powered by Shopify. Your purchase contract is with Halvane Living Ltd.

Please read these Terms together with:

  • Delivery Information: https://halvaneliving.co.uk/pages/delivery-information
  • Returns & Cancellations: https://halvaneliving.co.uk/pages/returns-cancellations
  • Privacy Policy: https://halvaneliving.co.uk/policies/privacy-policy

Nothing in these Terms or our other policies excludes or restricts your statutory consumer rights. If another website policy conflicts with these Terms concerning those rights, your statutory rights take priority.

SECTION 1 – ACCESS AND ACCOUNTS

You must be at least 18 years old to place an order.

You must provide accurate and current contact, payment and delivery information. You must be authorised to use the payment method supplied.

If you create an account, keep your sign-in details secure and tell us promptly if you suspect unauthorised access.

You are responsible for activity you authorise through your account. This does not make you responsible for losses caused by our failure to take reasonable care.

SECTION 2 – OUR PRODUCTS

We take reasonable care to describe products accurately, including their specifications, dimensions, materials and included components.

Images are illustrative. Screen settings can affect the appearance of colours, and lifestyle photographs may show accessories or surroundings not included in the purchase. The product description identifies what is included.

These qualifications do not affect your right to receive goods that match their description, are of satisfactory quality and are fit for any purpose made known to us and agreed before purchase.

Before ordering, check the product’s dimensions, access requirements, installation instructions and suitability for its intended location. Contact us if anything is unclear.

We may update products and descriptions for future purchases. We will not materially change an accepted order without your agreement.

SECTION 3 – ORDERS AND CONTRACT FORMATION

Placing an order is an offer to purchase the products in your basket.

An automatic order-received email acknowledges your order. It does not, by itself, confirm acceptance.

We accept your order when we send a dispatch confirmation, unless we have expressly accepted it earlier in a separate written communication. At that point, a contract is formed for the products covered by that confirmation.

We may authorise or take payment before acceptance. Taking payment alone does not constitute acceptance.

Before acceptance, we may decline an order because a product is unavailable, delivery cannot be provided, payment cannot be verified, there is a material pricing or description error, or we have reasonable grounds to suspect fraud.

If we cannot accept your order, we will inform you and refund any payment taken without undue delay.

Once we have accepted an order, we will not cancel or vary it merely because we have changed our mind. Any cancellation or change must be permitted by these Terms or applicable law.

Your statutory cancellation rights are explained in Section 6.

SECTION 4 – PRICES AND PAYMENT

Prices are displayed in pounds sterling.

Consumer prices include applicable taxes, including VAT where chargeable. Any delivery or other mandatory charges will be disclosed before you place your order.

We will not add optional charges without your express agreement.

Prices and promotions may change for future orders. Such changes do not alter the price of an accepted order.

If we identify a pricing error before acceptance, we will contact you with the correct price. You may choose whether to proceed. We will not charge a higher price without your agreement.

Payment methods available for your order are shown at checkout.

You must provide accurate billing information and be authorised to use your chosen payment method.

SECTION 5 – DELIVERY, ACCESS AND INSTALLATION

Delivery availability, charges, service level and estimated timing depend on the product and delivery address. Relevant information will be provided before your order is placed.

Some products are delivered directly by our suppliers or their appointed carriers. We remain responsible to you as the retailer.

Unless we agree a different delivery period with you, goods will be delivered without undue delay and within 30 days of the contract being formed.

If delivery is delayed, we will keep you informed. Your rights may include setting an appropriate additional delivery deadline or cancelling immediately where delivery by an agreed date was essential, or where we refuse to deliver.

If you lawfully end the contract because of non-delivery, we will refund the relevant payments without undue delay.

Goods remain at our risk until you, or a person you nominate other than the carrier, physically receives them. The statutory exception applies where you independently appoint a carrier that we did not offer.

Ownership passes once we have received full payment and the goods have been delivered.

Access and specialist delivery

Check road access, gates, doorways, stairs, clearances, unloading arrangements and the product’s packaged dimensions before ordering.

Tell us about access restrictions that may affect delivery. Any reasonably foreseeable additional delivery charges must be disclosed before purchase. If an unforeseen issue arises, we will discuss available options and any proposed additional charges before proceeding.

Kerbside delivery, room-of-choice delivery, assembly, installation, lifting equipment, groundworks and electrical work are included only where expressly stated for the product or agreed in writing.

Do not book non-refundable installation work until the product has arrived and you have checked it.

Receiving goods

Please inspect goods as soon as reasonably possible and report damage, missing components or incorrect items promptly.

Photographs and delivery notes help us investigate, but failing to identify damage at delivery or retain original packaging does not remove your statutory rights.

SECTION 6 – CANCELLATIONS, RETURNS AND REFUNDS

Your right to change your mind

For most goods purchased online, you may cancel without giving a reason from the time you place your order until 14 days after the day you receive the goods.

Where one order is delivered in separate shipments, the statutory cancellation period generally runs from receipt of the last item, subject to the applicable rules.

To cancel, email contact@halvaneliving.co.uk or send another clear statement that you wish to cancel. Include your name, order number and the products concerned where possible.

You do not need our permission to exercise a statutory cancellation right.

After notifying us, return the goods without undue delay and within a further 14 days, unless we have agreed to collect them.

Contact us for the correct return location and transport instructions. Do not send products to our registered office. Obtaining return instructions is an administrative step, not a condition that overrides your cancellation rights.

Return costs and condition

For change-of-mind returns, you bear the direct return cost only where we informed you of this before purchase.

For goods that cannot normally be returned by post, such as large fireplaces, saunas or garden buildings, we will provide the return cost or a reasonable estimate before purchase where required by law.

We do not impose a blanket restocking fee for exercising statutory cancellation rights.

You may inspect goods as you reasonably could in a shop. Where legally permitted, we may deduct an amount reflecting diminished value caused by handling beyond what is necessary to establish the goods’ nature, characteristics and functioning.

Please protect goods during return and use their original packaging where reasonably possible. Original packaging is not an absolute condition of your statutory rights.

Refunds

Where you cancel an entire eligible order, we refund the price paid and the cost of our least expensive standard delivery option. We do not have to refund the additional cost of a more expensive delivery option you selected.

For returns we have not offered to collect, we may withhold the refund until we receive the goods or evidence that you have sent them back, whichever happens first.

Refunds will be made without undue delay and within the applicable statutory deadline, generally within 14 days of receiving the returned goods or evidence of return. Where we have offered to collect, the applicable deadline generally runs from notification of cancellation.

We use the original payment method unless you expressly agree otherwise, and we do not charge a refund fee.

Exceptions

The statutory change-of-mind right does not apply to goods genuinely made to your specifications or clearly personalised, where the legal exception applies.

A product is not automatically exempt merely because it is ordered from a supplier, manufactured after purchase or selected from standard sizes, colours or finishes.

We will explain any applicable exception before purchase.

Exceptions to change-of-mind cancellation do not remove your rights concerning faulty, damaged or misdescribed goods.

Optional cancellation form

You may use the following form, but do not have to:

I hereby give notice that I cancel my contract for the following goods:

Ordered on / received on:

SECTION 7 – FAULTY GOODS AND WARRANTIES

Your goods must be of satisfactory quality, fit for their purpose and as described.

If goods are faulty, damaged or incorrect, contact us at contact@halvaneliving.co.uk with your order details and a description of the issue.

Your statutory remedies may include the short-term right to reject faulty goods, normally within 30 days, repair or replacement, and a price reduction or final rejection where the legal conditions apply.

We bear reasonable return or collection costs where required for faulty, damaged or incorrect goods.

A manufacturer’s warranty is additional to your rights against us. It does not replace them or require you to deal solely with the manufacturer.

Warranty coverage varies by product and will be described in the relevant product information or warranty documentation.

Follow applicable safety, installation and maintenance instructions. Damage caused by misuse or incorrect installation may not be covered, but unrelated statutory rights remain unaffected.

SECTION 8 – INTELLECTUAL PROPERTY

Our branding and original website content belong to Halvane Living Ltd or are used with permission.

Manufacturer names, trademarks, photographs and other supplier materials remain the property of their respective owners.

You may browse our website and save or print reasonable extracts for personal shopping purposes and to keep records of your purchase.

Commercial reproduction, redistribution or other use of protected material requires permission from the relevant rights holder, except where permitted by law.

SECTION 9 – OPTIONAL TOOLS AND THIRD-PARTY LINKS

Our website may provide access to third-party tools, embedded content or external websites.

Those providers may have their own terms and privacy notices. We do not control independently operated websites or their content.

This does not exclude our responsibility for services we agree to provide or for acts and omissions for which we are legally responsible.

If you purchase a product from Halvane Living, contact us about any problem with that purchase, even where a supplier or other third party is involved in fulfilment.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Halvane Living is powered by Shopify, which enables us to provide our online store.

Purchases from this store are made directly with Halvane Living Ltd, not Shopify. We are responsible for our obligations as the seller, including delivery, cancellations, refunds and statutory remedies.

Nothing in these Terms excludes any liability of Shopify or another party that cannot lawfully be excluded.

SECTION 11 – PRIVACY

Our use of personal information is explained in our Privacy Policy:

https://halvaneliving.co.uk/policies/privacy-policy

Shopify’s consumer privacy information is available at:

https://www.shopify.com/legal/privacy/consumers

Using our website or accepting these Terms does not, by itself, constitute consent to optional cookies, advertising measurement or marketing communications.

SECTION 12 – REVIEWS AND FEEDBACK

Reviews must reflect genuine experiences and must not be misleading, unlawful, abusive or infringe another person’s rights.

If you received an incentive for a review, disclose it clearly.

By submitting a review for publication, you give us a non-exclusive, royalty-free licence to display it and reproduce it in connection with the relevant product and our store. You retain ownership of your content.

We may make minor formatting edits without changing the meaning. We will not present a review in a misleading way.

We may remove unlawful content, spam or content that breaches these Terms. We do not remove genuine reviews merely because they are negative.

Private customer-service correspondence is not automatically treated as permission to publish a testimonial.

SECTION 13 – ERRORS AND WEBSITE INFORMATION

We take reasonable care to keep website information accurate and current.

We may correct errors and update information for future transactions. Corrections do not give us an unrestricted right to alter or cancel accepted orders.

General guides do not replace product-specific instructions or professional advice where installation, electrical work or other specialist work is required.

This does not exclude responsibility for inaccurate information where we are legally responsible.

SECTION 14 – PROHIBITED USES AND AUTOMATED ACCESS

You must not use the website to:

  • Commit fraud or another unlawful act.
  • Submit deliberately false information.
  • Harass or threaten others.
  • Infringe intellectual property or privacy rights.
  • Upload malware or interfere with website security.
  • Gain unauthorised access to accounts or systems.
  • Collect personal information without a lawful basis.
  • Send unsolicited bulk communications.
  • Place fraudulent orders or manipulate reviews.

Automated tools must not bypass security measures, evade access restrictions or place an unreasonable load on the website.

We may restrict abusive or unauthorised access. This does not prevent legitimate accessibility tools or ordinary search-engine indexing that complies with our technical controls.

SECTION 15 – SUSPENSION AND TERMINATION

We may restrict or suspend access where reasonably necessary to address fraud, security risks, unlawful activity or a serious breach of these Terms.

Where appropriate, we will explain the reason and allow a reasonable opportunity to resolve the issue.

Suspending an account or website access does not remove your rights under an existing purchase contract, including rights to delivery, cancellation, refunds and remedies.

SECTION 16 – WEBSITE AVAILABILITY

We aim to keep the website available and secure but cannot promise uninterrupted or error-free access.

We may temporarily suspend parts of the website for maintenance, security or technical reasons.

We do not sell products on an “as is” basis that excludes your statutory rights to satisfactory quality, fitness for purpose or conformity with description.

SECTION 17 – OUR LIABILITY

We are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.

Loss or damage is foreseeable where it is an obvious consequence of a breach or was contemplated by you and us when the contract was made.

We supply products under these Terms for domestic and private use. We do not accept liability under this consumer contract for business losses such as lost business profits, business interruption or lost commercial opportunities.

We do not exclude or limit liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of your statutory rights concerning goods.
  • Defective products where liability cannot lawfully be excluded.
  • Any other liability that cannot lawfully be excluded or limited.

You must take reasonable steps to avoid or reduce loss, but this does not require unreasonable expense or inconvenience.

SECTION 18 – RESPONSIBILITY FOR MISUSE

You may be responsible for loss you cause through fraud, unlawful conduct or a breach of these Terms, to the extent permitted by law.

We do not require consumers to provide an unlimited indemnity or reimburse us for losses caused by our own breach, negligence or unlawful conduct.

SECTION 19 – EVENTS OUTSIDE OUR REASONABLE CONTROL

If an event outside our reasonable control affects fulfilment, we will contact you as soon as reasonably possible and take reasonable steps to reduce its impact.

Such events do not remove your statutory delivery or cancellation rights.

Where there is a substantial delay, you may have a right to end the contract and receive a refund for products not supplied.

SECTION 20 – SEVERABILITY AND ENFORCEMENT

If a court finds a provision unlawful or unenforceable, the remaining provisions continue to apply where legally possible.

If we delay enforcing a right, that does not mean we have permanently given it up.

Where a consumer term has more than one meaning, it will be interpreted as required by applicable consumer law.

SECTION 21 – THE AGREEMENT AND TRANSFERS

The contract includes these Terms and the product, price, delivery and other information forming part of your order.

Nothing excludes information or representations that the law treats as binding, or liability for fraud or misrepresentation.

We may transfer our rights and obligations only where this does not reduce your contractual protections. We will notify you where a transfer affects an ongoing contract.

Contact us if you wish to transfer your contractual rights to another person. Any manufacturer warranty transfer is subject to its applicable terms, without affecting rights that cannot lawfully be restricted.

SECTION 22 – GOVERNING LAW AND COURTS

These Terms are governed by the law of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you retain the benefit of mandatory consumer protections applicable where you live.

Proceedings may be brought in the courts of England and Wales. Consumers living in Scotland or Northern Ireland may also bring proceedings in the courts of their home jurisdiction.

Nothing in these Terms removes any other mandatory rights concerning applicable law or jurisdiction.

SECTION 23 – COMPLAINTS

If you have a complaint, contact contact@halvaneliving.co.uk or call 0333 335 6486.

Please include your order number, the nature of the issue and the outcome you are seeking.

We will investigate and seek to resolve the matter fairly. Where a dispute remains unresolved, we will provide information about alternative dispute resolution where legally required, including whether we are obliged or willing to participate.

SECTION 24 – CHANGES TO THESE TERMS

We may update these Terms for future orders and website use.

The version applicable when your purchase contract was formed continues to govern that purchase unless we agree a lawful change with you.

We will not retrospectively remove your rights by updating this page.
